A client of ours, Ms A, is a survivor of two separate rapes by two separate assailants on the same evening. We felt it was necessary to make two separate claims for our client and advised our client she should receive £11,000.00 for each incident.

The CICA refused to pay our client out for two separate incidents. They instead made an award for one incident as the assaults both occurred on the same evening and refused to make a payment on the separate ongoing claim. The CICA refused the claim on the basis that the offenders were known to one another therefore there was no evidence that they were not aware of each other’s actions.

We then argued this decision and made an application for review to the CICA to which they responded refusing the claim once again. We then made an appeal to the Tribunals Service for this case to be assessed.

Upon attending the hearing to represent our client we achieved an outcome of £22,000.00 for our client. The Tribunals Service agreed with our valuation and that our client should be awarded for two separate incidents instead of one.

A few weeks after the hearing our client then received the compensation they deserved which was £22,000.00.
